Yoga Adventures LLC doing business as Park City Yoga Adventures (PCYA) WAIVER OF CLAIMS, MEDICAL WAIVER, EXPRESS ASSUMPTION OF THE RISK, RELEASE OF LIABILITY, AND INDEMNITY AGREEMENT

PLEASE READ AND SIGN LIABILITY WAIVER AND CONTRACT

This contract shall be binding as of today and for all future transactions with PCYA.  I understand the paddleboarding, paddleboarding yoga, hiking, snowshoeing, yoga in silks, and yoga and all other related activities to be conducted under this contract have inherent risksand PCYA, it’s agents, successors or assigns will not be held responsible for such personal risk. I acknowledge that snowshoeing, hiking, practicing yoga, paddleboarding, and paddleboarding yoga, yoga in silks, ect have many risks, hazards, and dangers particularly in a wilderness environment.  I understand that these risks, dangers, hazards include without limitation: 1. Falls 2. Improperly used equipment, equipment failures, negligent actions of other paddleboarders, hikers, snowshoers 3. Encounters with wildlife, animals, insects 4. Temperature extremes 5. Inclement weather conditions and unavailability of medical attention in the wilderness in an event of injury.  I acknowledge and declare that I can swim sufficiently well to undertake the activities to be conducted under this contract and I am not aware of any physical, emotional, or mental conditions that would or might put me or anyone else at risk through the activities to be conducted under this contract.  I will use all of the equipment at my own risk.  I waive any claim whatsoever against PCYA, its agents, successors or assigns related to my use or possession of rental property.  I agree to indemnify and hold harmless PCYA, its agents, successors and assigns for all injured accidents, or other claims, including attorney fees and costs arising from or connected to the rental property or lessons. PCYA does not warrant or guarantee the rental property in any fashion nor for any particular use or purpose.  I will pay all attorney fees and costs incurred if any suit or claim is brought against PCYA or its agents, successors, or assigns related to this contract.  The laws of the state of Utah govern this contract.  Any suit or claim arising from this contract shall be brought and maintained in Summit County, Utah.  I waive the right to a jury trial in any suit arising from or in connection with the contract and submit to the personal jurisdiction of the courts of Summit County, Utah.  This contract shall be binding upon all parties, their heirs, successors, and assigns. 

All photographs taken during PCYA trips are property of PCYA and can be used on the web and for advertising purposes for PCYA.

I am physically and emotionally fit and medically sound to participate in Yoga Adventures. 

I have read and understand the above contract. I also authorize PCYA to charge my credit card in the event I cancel within 48 hours or don’t show up or cancel within 48 hours of my tour.
